Public Participation in BOE Meetings

The Board of Education welcomes public comment during the Public Comment portion of the agenda. Those who wish to address the Board should state their name and limit their statement to five minutes. Comments are not restricted to items on the agenda; however, comments regarding specific student discipline cases or individual employee matters are discouraged during Open Session. Generally, these types of comments should come to the Board only after they have been referred to the teacher, principal, or administrator who is closest to the situation. This statement does not mean that the Board prohibits such criticism. The Board recognizes that criticism of individuals is protected under the First Amendment in the absence of disruption. However, the Board encourages a forum that values mutual respect, demonstrates good citizenship and models appropriate advocacy. Moreover, the Board encourages commenters to present criticisms regarding individuals to the appropriate authority under Policy  3:30 (Chain of Command). If a public comment veers towards complaints regarding an individual, nothing prevents the Board from interrupting to ensure that the speaker understands the Board’s preferences and to remind speakers that they may be liable under the law for false and defamatory statements or publication of private information about an individual. However, such commenters will be allowed to proceed in the absence of any substantial disruption.
